Privily Service Terms of Use

This notice describes the terms of your use of the Privily service. Privily is a service provided by IOR Analytics, a Texas LLC that enables individuals to make privacy related inquiries and requests to Privily’s participating businesses. Privily provides this service to participating businesses, enabling them to provide better, more convenient service to individuals. References in this notice to “we” or “us” refer to IOR Analytics, LLC, doing business as Privily.

References to “you” refer to an individual consumer - referred to as a “data subject” in some laws, such as the EU General Data Protection Regulation (GDPR).

Read these terms carefully. Your use of the Privily service constitutes your agreement to these terms.

The participating business’s terms apply

If you make a request to a participating business using Privily, we act as a service provider or processor to the business. Privily’s role is limited to facilitating your communication with the participating business and helping the participating business receive, track, and respond to your request. Privily does not determine the purposes and means of processing and handles your information only as dictated by the terms of our agreement with the participating business. Because of this, the privacy notice and terms of use of the participating business control.

For example, if you are making a privacy inquiry to Acme, Inc. Acme's terms of use and privacy notice apply. To the extent these differ from any notice or terms found here or elsewhere on a Privily or IOR website, the participating business’s terms of use and privacy notice apply.

The following additional terms apply

Prohibited activities

When using Privily, you will not:

Knowingly provide untrue or incomplete information, including false or misleading information about your age, residence, use of the participating business’s products or services, or any other untrue information.

Upload or submit false, misleading, threatening, or illegal information about any individual.

Submit requests on behalf of any individual without their permission.

Use automated means such as scripts, “bots”, APIs, automated programming routines, or any other means to submit information. Privily is intended for use by “live” individuals only.

Submit duplicate, repeated, frivolous, unfounded, or harassing requests to a participating business.

Reverse engineer any component of the Privily website or services.

Legal Capacity

Privily is intended for use only by individuals of sufficient age and legal capacity to make privacy requests according to the law of the region in which they reside or currently are. If you are not of suitable age to make a privacy request in your jurisdiction, you must have a parent, guardian, or other authorized representative make your request for you. If, for any reason you lack legal capacity to make your own privacy request, you must have a parent, guardian, or other authorized representative make your request for you.

Questions or complaints

If you have a question or complaint about your use of Privily to submit a privacy request to any participating business, you should contact the participating business. You can do so through Privily or by referring to the business’s general instructions for submitting privacy or other questions.  

If you have a general question about Privily, you may contact us. Note that for any questions related to a specific business, we will be required to communicate your question or complaint to the participating business and may be prohibited from sharing specific information.

Intellectual property

All Privily and IOR logos, trademarks, and trade dress are property of IOR Analytics, LLC. Any participating business logos, trademarks, or trade dress are property of the participating business and used with permission.  

Our site and all of its contents (blog posts and articles, text, photographs, images, illustrations, graphics, video material, audio material, and software are intellectual property protected by copyright, trademark, and other laws of the United States, and also by international conventions and the laws of other countries. The intellectual property is owned or controlled by IOR Analytics, Inc. or other parties from whom we have licensed it. Additionally, the site itself is protected by copyright. No portion of this site may be reproduced, duplicated, copied, sold, or otherwise exploited for any commercial purpose without our express written permission.

Governing law

For any question or issue arising directly between you and us, these terms of use are governed by the laws of Texas, without reference to its conflicts of laws principles.

For any question or issue arising out of your use of Privily to interact with a participating business, we act only as a processor or service provider to the business. Any such question or issue is directly between you and the participating business and subject to the terms of use and privacy notice of the participating business, including the applicable choice of law provisions.

Updates to this Service Terms of Use

This Service Terms of Use was last updated 23 October, 2024 and may be updated from time to time. We encourage you to check this page periodically to verify the current service terms of use in effect. Your continued use of Privily after an update to this notice indicates your acceptance of the terms of any new service terms of use.
